Article 1 – OBJECT

These General Terms of Sale define the terms of online sales of ARGILETZ S.A. PRODUCTS.) To simplify the understanding of these conditions, it is agreed that the User and LABORATOIRE ARGILETZ S.A will be referred to as the “Parties” and individually referred to as “Part,” and that the user who has validated an order will then be referred to as “Buyer.” The User’s rights and obligations necessarily apply to the Buyer. The order developed by the User will not be deemed valid until the user has consulted and accepted the present terms and conditions of sale without any reservation, but this acceptance is conditional on a handwritten signature on the part of the User. In accordance with the provisions of the articles: 1125 and following of the Civil Code and following and following of the Civil Code , it is recalled that the validation of the purchase order as specified in Article 3.3. is an electronic signature between the Parties that has the same value as a handwritten signature. These conditions apply to the exclusion of any other document.

Article 2 – ORDER

All products on offer are intended only for sale to individuals. Any company, association, for-profit or non-profit organization should contact the company LABORATOIRE ARGILETZ via the email info@argiletz.com to inquire about the conditions of sale reserved for professionals.

When the Buyer confirms his order by clicking on the buttons   “I validate my   order” and   “I have read the terms and conditions of sale and I accept them without   reservation” he declares that he accepts it and all of these General Terms of Sale fully and unreservedly. He has the option to print his purchase order.

Any order is worth accepting the price corresponding to the product ordered. Once the order has been made, the Buyer has the opportunity to verify the product (s) ordered and the total price of his order on the order confirmation addressed to him. This order confirmation is worth accepting the order and validating the transaction.

The Buyer accepts that the order registration systems are worth proof of the purchase and its date.

ARGILETZ undertakes to honor online orders only within the limits of available stocks. In the absence of availability, ARGILETZ undertakes to inform the Buyer by email or phone as soon as possible. ARGILETZ will then automatically cancel the order. The Buyer will be refunded within thirty (30) days from the date of receipt of the email stipulating the cancellation.

The buyer does not repackage any purchased product.

Article 3 – PRICE

Prices are listed on this Site in Euros all taxes included, at the VAT rate applicable on the day of the order and are likely to vary during the year, without notice.

For deliveries outside France, the provisions of the general VAT tax code apply.

In the event of an order to be delivered outside the European Union, the entire import customs procedure (following the export), as well as the amount of customs duties will be borne by the buyer and under his responsibility.

Product prices do not include shipping costs. These fees will be known to the user at the time the order is validated.

Promotional offers are only valid within the double validity of the offer concerned and the stocks available.

An invoice will be issued to each order.

Article 4 – PAYMENT MODALITIES

The Buyer assures ARGILETZ that he has the necessary authorizations and funds to use the payment method he has chosen for his Order, when registering the Order. The order will be considered final after confirmation of the agreement of the bank payment centres.

In case of non-payment, ARGILETZ will automatically cancel the order.

Payment is made online, by credit card or by Paypal, cash to order.

By making an immediate payment by bank card or Paypal, the User will then be automatically switched to the monetic server of the secure payment platform (P@iement CIC or Paypal). This platform is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data related to the means of payment, and that at no time will the Buyer’s banking data pass through the ARGILETZ computer system.

Article 5 – SHIPPING

The delivery of parcels is provided by Mondial Relay in relay points (France) and domicile in some countries, and by the Post Office in COLISSIMO for any parcels less than 30kg in France and the European Union and 20kg for the rest of the world. Once your order is prepared and shipped, it is delivered Mondial Relay or COLISSIMO followed in about 2-3 working days (France) and 4-5 working days (Outside France).

The delivery address should not be a post office box. If this were the case, the order could not be taken into account.

Deliveries abroad are made in the   “unpaid   duties” (DAP) mode at the destination indicated in the order, with the buyer paying for all customs formalities and their costs.

Shipping costs (for metropolitan France only) are offered from 35 euros of order (or reduced for large orders).

Article 6 – ORDER PREPARATION

The preparation time for the order is in principle 7 days from the confirmation of the order. The payment must be validated by our banking systems before the order is departed. Orders are delivered to the Post Office once a week, on Thursdays, with exceptions. Any orders that have been paid after 12:00 p.m. on Thursday will be shipped the following week.

Article 7 – PRODUCT RETURN / RIGHT OF RECTRACTATION

Normally, the Buyer has a legal period of fourteen (14) free days from the receipt of the Products to exercise his right of withdrawal. However, in this period of health crisis, the legal period of return increases exceptionally to thirty (30) free days.

Return   terms:

1/Before any return, within 30 days of receipt, the Buyer must send an email to the following   address: info@argiletz.com to request a return number. The Buyer must specify in his return request, his contact details (name, address, customer number) the number of the order, the item (s) that he wishes to return with their reference indicating the reason for the return.

2/ The cost of returning the order (total or partial) is the responsibility of the Buyer.

3/ The right of withdrawal can only be exercised for complete products, in their original condition and packaging accompanied by a copy of the purchase invoice. Incomplete, damaged, soiled, damaged or outside of their original packaging will not be taken back.

Items that have been requested for return must be shipped to the address below within 30 days of the return number being   communicated:

4/ ARGILETZ will refund payments received from the Customer within a maximum   of:

– Fourteen (14) days from the day ARGILETZ received the products returned by the Buyer, in the case of an order paid by card or bank transfer.

– Thirty (30) days from the day ARGILETZ received the products returned by the Buyer, in the case of an order paid by cheque.

The refund will be made by bank transfer only.

Article 8 – CLAIMS

The customer is required to check the condition of the packaging and the quantity of products delivered.
Any claims relating to the delivery of products must be notified by the customer within 72 hours of receiving them by sending:

In the event of a proven non-compliance of a product or all of the products delivered, ARGILETZ undertakes to exchange the non-compliant product or products at its own expense.

Article 9 – REPONSABILITY

ARGILETZ strives to ensure the accuracy and updating of the information on the Site to the best of its ability, and that it reserves the right to modify, at any time and without notice. ARGILETZ disclaims any liability for damages resulting from a fraudulent intrusion by a third party that resulted in a change in the information contained on the Site.

Similarly, photographs and texts reproduced and illustrating the Products presented, in view of the digital presentation of products on the Internet, can induce a misperception by the Buyer of photography. As a result, the Buyer will be free to exercise his right of withdrawal within the aforementioned deadlines.
